Moussaoui Case Weakened by Justice Dept.

There is another confrontation looming between the government and the judge in the case of the alleged September 11th conspirator, - the so-called "20th hijacker," Zacarias Moussaoui.

One week ago, Judge Leonie Brinkema ruled that Moussaoui must be given access to two detainees who could potentially help his case.

The government refused, but countered by offering to provide written summaries of what the Al Qaeda captives might say, if they could testify.

Judge Brinkema said that would not suffice. A showdown approaches, and the Justice Department yesterday acknowledged it is risking the dismissal of the charges.
