When most people think of the Supreme Court they see it in terms of conservatives versus liberals. It's a balance that can be disturbed by the appointment of another judge leaning left or to the right.

With the health of Chief Justice Rehnquist in question that moment could come very soon.

Mark Tushnet is a professor of constitutional law at Georgetown University Law Center. He's the author of a new book titled: "A Court Divided the Rehnquist Court and the Future Constitutional Law." And he says there's another divide that it isn't along party lines.
