The limits of presidential power and the constitutionality of military tribunals for Guantanamo Bay detainees are being considered at the U.S. Supreme Court Monday, in a case that has some calling for a recusal second Supreme Court Justice Antonin Scalia.

Justices heard 90 minutes of legal arguments instead of the usual 60 this Tuesday morning, in the case of the one-time driver for Osama bin Laden, who has been held at the detention center on Cuba following his capture in Afghanistan two months after the 9/11 attacks.
